Owner: Legal & Regulatory Practice Lead

Prerequisites & Required Authorizations

  • Proof of carbon tax payment or emissions trading registry receipt in the country of manufacture.
  • Verification statement confirming non-receipt of export rebate or subsidy.

Expected Outcome

Net deductible carbon price calculated in EUR/tCO2e and incorporated into the CBAM declaration package.

1. Legal Basis & Requirements

Under Article 9 of Regulation (EU) 2023/956:

An authorized CBAM declarant may claim a reduction in the number of CBAM certificates to be surrendered to account for the carbon price effectively paid in the country of origin for the declared embedded emissions.

Important

To qualify for Article 9 deductions:

1. The carbon price must be statutory (e.g. India CCTS compliance cost, domestic carbon tax).

2. Any export rebate, free allocation, or compensatory tax refund received must be fully deducted.

3. Supporting payment proof must be certified by an independent auditor.

2. Step-by-Step Procedure

Step 2.1: Open Article 9 Credit Module

1
Navigate to CBAM Compliance→Origin Carbon Price (Art. 9).
2
Click + Record Carbon Price Paid.

Step 2.2: Enter Tax / Market Transaction Details

1
Select the Origin Country (e.g. India).
2
Select the Statutory Mechanism:
•ccts_compliance_purchase (Carbon Credit Certificates under ECA 2001)
•domestic_carbon_cess (Clean Energy Cess / Coal Tax)
•subnational_ets
3
Enter the gross price paid per metric tonne of CO_2e in local currency (e.g. INR 1,250 / tCO2e).
4
Enter any rebate or free allocation discount received per tonne.
5
Provide the official exchange rate published by the European Central Bank (ECB) on the date of transaction.

Step 2.3: Attach Audit Proof & Link to Quarter

1
Upload the official tax treasury challan or carbon registry transaction receipt.
2
Upload the independent auditor's non-rebate certification statement.
3
Link the record to the applicable quarterly declaration.
4
The system calculates the net deductible amount in EUR and updates the CBAM certificate liability forecast.
